Non-filed returns and unpaid sales taxes

Client X came to my practice in 2003.  He had a business some years earlier and had failed to file his sales tax returns.  The client had also failed to pay the tax due.  The client’s sales tax returns were prepared and filed after negotiating with the Kansas Department of Revenue.  The client had over $15,000 in tax, penalty and interest forgiven.  Client X paid zero tax.  The key for this client was the written agreement negotiated with the KDoR.  Because the client had not operated the business for some time it was possible to draft a settlement agreement with the KDoR that excluded all tax, penalties and interest.   This is a fairly common situation with individuals that have closed a business and my practice has seen similar clients on many occasions.
